A sober word from a writer who has offered many insights aver the years, but who is now withdrawing from writing life:

Interesting article mainly about the affirmative action cases (Students for Fair Admissions Inc. v. President & Fellows of Harvard College, Students for Fair Admissions, Inc. v. University of North Carolina), but also about Chief Justice John Roberts’ ability to lead (or shape or influence) the Supreme Court — Joan Biskupic, “John Roberts shows he still has a grip on the Supreme Court,” CNN (Nov. 1, 2022) [link]:

  • The chief justice repeated his enduring view that race should not matter, and he denounced admissions practices that consider students’ race or ethnicity for campus diversity. He suggested that if the court were to uphold the current policies at Harvard University and University of North Carolina, racial affirmative action would never end. “Your position is that race matters because it’s necessary for diversity, which is necessary for the sort of education you want,” he told North Carolina state solicitor general Ryan Park, who was defending the UNC program. “It’s not going to stop mattering at some particular point; you’re always going to have to look at race because you say race matters to give us the necessary diversity.”

I remember reading (in the ’80s) Stephen J. Gould on why there would never be another .400 hitter in baseball (“Complex systems improve when the best performers play by the same rules over extended periods of time. As systems improve, they equilibrate and variation decreases.”), and then Michael Lewis’ Moneyball (2003). Put this article in the same lineage: Derek Thompson, “What Moneyball-for-Everything Has Done to American Culture,” The Atlantic (Oct. 30, 2022) [link]:

  • The analytics revolution, which began with the movement known as Moneyball, led to a series of offensive and defensive adjustments that were, let’s say, catastrophically successful. Seeking strikeouts, managers increased the number of pitchers per game and pushed up the average velocity and spin rate per pitcher. Hitters responded by increasing the launch angles of their swings, raising the odds of a home run, but making strikeouts more likely as well. These decisions were all legal, and more important, they were all correct from an analytical and strategic standpoint.

What makes this article a continuation of the arguments (rather than a recapitulation of the idea) is the suggestion that this endemic in our time. Plus, I like the phrase “catastrophically successful.”

Essay questions from the Primer

Neal Stephenson, The Diamond Age: or A Young Lady’s Illustrated Primer (1995):

  • “[He] began to develop an opinion that was to shape his political views in later years, namely, that while people were not genetically different, they were culturally as different as could be, and that some cultures were better than others. This was not a subjective value judgment, merely an observation that some cultures thrived and expanded while others failed.   • “[A]s many first-time fathers had realized in the delivery room, there was something about the sight of an actual baby that focused the mind. In a world of abstractions, nothing was more concrete than a baby.” p. 150

Each of these is thought or voiced by one of the father figures in this novel. Discuss among yourselves.

Race Empathy

One of the great benefits of reading, particularly novels and memoirs, is its ability to promote the kind of empathy Atticus Finch describes to Scout: “You never really understand a person until you consider things from his point of view . . . until you climb into his skin and walk around in it.”

Solitary

 

Albert Woodfox, Solitary (2019) [amazon] is the memoir of a black man in prison who spent nearly all of his life in prison in Louisiana for a murder he could not have committeed. I wrote a review and also posted some quotations from the book. [review] [post].Invisible

Stephen L. Carter, Invisible (2018) [amazon] is the biography of Eunice Hunton Carter, Stephen Carter’s grandmother, who Amazon describes as “a woman and a prosecutor, a graduate of Smith College and the granddaughter of slaves, as dazzlingly unlikely a combination as one could imagine in New York of the 1930s.”

Between the World and Me (2015) is Ta-Nehisi Coates’ heartbreaking memoir for his son about what it means to grow up as a black man in white America. Not an easy read. I’ve read this book several times and wrote a couple of posts. [post] [post]Extraordinary

Extraordinary, Ordinary People (2010) [amazon] is former Secretary of State Condoleezza Rice’s fascinating (and touching) memoir of her parents, as she grew up in the 1950s and 1960s in Birmingham.Underground Airlines

Ben H. Winters, Underground Airlines (2016) [amazon] is an excellent dystopian novel about race and control.

Incidents

Harriet Ann Jacobs, Incidents in the Life of a Slave Girl Written by Herself (1861) [amazon] is an astounding autobiography of a woman raised in slavery, who escaped her bondage.

And of course, don’t forget Harper Lee’s incomparable To Kill a Mockingbird (1961) [amazon], which you were supposed to read in junior high! Sissy Spacek does a beautiful reading of the book. [audible]

Let Justice

Many of you are aware of Andrew Peterson’s online Christian Community The Rabbit Room (rabbitroom.com).

In August The Rabbit Room is sponsoring an online reading group on John Perkins’ 2006 Autobiography Let Justice Roll Down.* I thought it sounded interesting and I’ve signed up to participate.

John Perkins was a sharecropper’s son who left Mississippi for California, but came to Christ and returned to minister and devote his life to reconciliation:

“His brother died in his arms, shot by a deputy marshall. He was beaten and tortured by the sheriff and state police. But through it all he returned good for evil, love for hate, progress for prejudice, and brought hope to black and white alike. The story of John Perkins is no ordinary story. Rather, it is a gripping portrayal of what happens when faith thrusts a person into the midst of a struggle against racism, oppression, and injustice. It is about the costs of discipleship—the jailings, the floggings, the despair, the sacrifice. And it is about the transforming work of faith that allowed John to respond to such overwhelming indignities with miraculous compassion, vision, and hope.”

Stephen L. Carter, “How We Got to Capital-B ‘Black’: America’s long conversation about race has often stumbled over which specific words to use,” BloombergOpinion (July 1, 2020) [link]:

In the wake of the protests following the killings of George Floyd, Breonna Taylor and too many others, editors everywhere have decreed with sudden and remarkable unanimity that the formerly common adjective referring to African Americans will henceforth be a proper adjective.

I’m all for the change. Yes, as a card-carrying Grammar Curmudgeon I have a few curmudgeonly concerns. But before we get to that part, let’s do a little history.

Over the past half millennium, the U.S. and its predecessor colonies have invented all sorts of ways to refer to the Africans they bought and sold and their many generations of descendants. Many of those terms were derogatory at the time; most are considered derogatory today. The nation’s difficulty in finding the proper word to describe a people dragged unwillingly to its shores itself mirrors the difficulty the nation has had in digesting the original crime.

Carter continues to look at the history and significance of the usage, with his usual insight. Alas he is behind the Bloomberg paywall, and (so far as I am aware) his earlier columns are not released after a period of captivity like some other writers. See, e.g., Peggy Noonan [link]. Sarah Willard, “Remember This,” Blind Mule Blog (June 29, 2020) [link]:

small quotes blueIn January I wrote the word Eucatastrophe down on a scrap of paper and propped it up on my desk. A sudden turn of good events, it means, which ensures the protagonist does not meet some very probable doom. It was with barely a mustard seed of belief that I wrote it down. Really I just liked the way it looked on paper. I didn’t name it and claim it. I didn’t presume to pray for it. I was, in fact, avoiding it personally.

Great word, Sarah, and one we need to remember. She gives us a scrap of story about unexpected grace.


Nadia Nadim, “The Outsiders,” The Players’ Tribune (June 18, 2020):

small quotes blueAlthough I’m encouraged by the Black Lives Matter protests, I still feel that too many people have become numb to what’s going on in certain parts of the world. Take one of them aid campaigns about Africa, where children are suffering from hunger. People see it, in the literal sense, but they don’t really see it. You know? But then let’s say that you live in Denmark, where I arrived when I was 12, or in any other privileged country. If two Danes die or get killed in Africa or Syria or wherever, that’s suddenly big news. You’re like, “Oh my God. They were Danish!!” 

This is a different story than we are used to.


Rebecca Manley Pippert, Stay Salt (2020) [link]:

We do not need to get angry, shouting at our culture. We do not need to feel defeated, staying silent in our culture. We can be hopeful, as we share the message that the whole word so desperately needs to hear. To put it another way, we can still be disciple-makers. We can—we must—stay salt!


Voddie Baucham, “Racial Reconciliation,” YouTube (2019) [link]:

small quotes blueIf God can reconcile those who have real and God-ordained distinctions between them, He can certainly reconcile people who have arbitrary and artificial differences and distinctions between them.

This is a very powerful sermon—by the way, Dr. Baucham is not (1) saying there is no problem, or (2) reading books is worthless, or that (3) we can experience no peace with non-believers. What he does say is worth multiple hearings.

Dr. Baucham has many online sermons—does anyone have other suggestions? This was the first I had heard.

But many will stand by him out of a sense of self-protection, hoping a miracle keeps him in the White House as a firewall against whatever post-2020 liberalism might become.

This is a natural impulse, but they should consider another possibility: That so long as he remains in office, Trump will be an accelerant of the right’s erasure, an agent of its marginalization and defeat, no matter how many of his appointees occupy the federal bench.

This post is not a simple criticism so much as an actual answer to the question raised.


Peggy Noonan, “On Some Things, Americans Can Agree: George Floyd’s killing was brutal. Good cops are needed. And Trump hurt himself badly this week.” The Wall Street Journal (June 4, 2020) [link]:

I am proud of Peggy Noonan and George Will and others for being willing to speak truth to the political powers that were their home fans. George Will famously left the Republican Party before the 2016 [link] election, and has continued to write bluntly (not protectively) about the Administration (his opinions are behind the Washington Post paywall).

Political SCOTUS?

Evangelisto Ramos was tried for second degree murder in Louisiana in 2016. After a two-day trial the jury voted 10-2 to convict him.

In 48 states (and in federal court), this would have resulted in a “hung jury” and a mistrial. Unfortunately for Mr. Ramos, he was tried in Louisiana, which (along with Oregon), permits non-unanimous verdicts, so he was convicted and sentenced to life in prison.

The question before the Court was whether the conviction was constitutional.

On this point—the point which Evangelisto Ramos was most interested in—the Court decided (6-3)1 that his conviction was not constitutional.


Here’s the scorecard:Ramos


Justice Gorsuch, who needed four Justices to join him, managed to make a 5-4 majority out of Justices Ginsburg, Breyer, Sotomayor, and Kavanaugh for most of his nine-part opinion. Gorsuch and Kavanaugh, of course were appointed by President Trump. Ginsburg and Breyer were Clinton appointees. Sotomayor was appointed by President Obama.

That means that Gorsuch could not attract the votes of the Chief Justice Roberts or Justice Alito (both George W. Bush appointees) or Justice Kagan (an Obama appointee) for any of his opinion, and that Justice Kavanaugh (Trump) couldn’t agree with him on three parts, and Justice Sotomayor (Obama) could not agree on one part. Justice Thomas (President George H.W. Bush) thought the conviction was unconstitutional, but for a more-or-less completely different reason, so he did not agree with Gorsuch on anything that he wrote, just the decision he made.

Who says that Supreme Court justices vote politically?


1The only other part of the 87 pages of opinions that were published today that garnered this kind of majority was that Chief Justice Roberts, and Justices Thomas, Alito, Sotomayor, Kagan and Kavanaugh agreed that whatever Justice Gorsuch thought he meant by part IV.A. of his opinion could not possibly be right.

NOTE: The greyed-out sections of the chart represent the parts that are not legally binding—73 out of 87 pages!

P.S. One headline “Supreme Court rules criminal jury verdicts must be unanimous, overturning decades-old precedent,” rather misses the point. Ramos overturns a lone case which stuck out of 500 years of precedent and which was of doubtful coherence—a 4-person plurality opinion combined with an odd 1-person opinion by Justice Powell—that “decided” that Louisiana could sort of get away with it, though Gorsuch writes that “no Member of the Court today defends either [the opinion of the four or the opinion of the one] as rightly decided.”
